Arnstein & Lehr Fort Lauderdale Partner Lori Adelson was quoted in a March 30 article in Business Insider. The article, titled “Why Companies Could Get In Trouble For Accessing Your Facebook Page,” discusses a recent hot topic regarding the legality of employers asking prospective employees for their Facebook passwords to check for conducts such as disorderly behavior. Ms. Adelson comments that password snooping is legal, however employers could open themselves up to liability by doing this because they could be sued for discrimination if they then decide not to hire the applicant. Ms. Adelson was the only source for the story and was quoted throughout.
